1. Introduction

1.1 These General Terms of Sale (“General Terms”) apply to the sale of products by Safe Outdoor Shop to you. Safe Outdoor Shop is a company of Shiptron, registered in The Netherlands and our business address is De Dolfijn 24, 1601 MG Enkhuizen, The Netherlands.

1.2 Our Privacy Policy also applies to your use of the Website. Please read the Privacy Policy carefully for important information about our privacy practices.

1.3 Please read these Terms and Conditions carefully before ordering any products on safeoutdoor.shop. By ordering products from this website, you indicate your agreement to these Terms and Conditions. These constitute a legal agreement between you and us and can only be changed with our consent.

1.4 We reserve the right to modify these Terms and Conditions from time to time without notice by updating them on the Website, provided that such modification does not affect any purchases you have made prior to the modification being made.

2. Order

2.1 You can place an order to purchase a product advertised/shown on our website for sale by following the on-screen instructions after clicking on the product you are interested in. You will have the opportunity to check and correct input errors in your order until the time you ship your order.

2.2 After you place an order with us, you will receive an email confirming receipt of your order. Please note: This email is a confirmation of receipt and not an acceptance of your order.

2.3 Acceptance of your order and the formation of a contract between us take place when we send you an email confirming that the products ordered are being shipped to you, unless we have notified you that we do not accept your order or that you have already cancelled it.

2.4 You can check the status of an open order at any time by looking up the relevant order after logging into the ‘Your Account’ section of the site. Please use the username and password we asked you to create to become a registered customer of the site.

3. Prices and payment

3.1 The price of the products is as stated on our site, except in case of obvious errors. Product prices include VAT at the prevailing rate. The price listed on our site does not include shipping costs which are listed separately on our site. You can place an order to purchase a product advertised/shown on safeoutdoor.shop by following the on-screen instructions after clicking on the product you are interested in. You will have the opportunity to check and correct input errors in your order until the time you ship your order.

3.2 Prices are subject to change at any time prior to (but not after) acceptance of your order.

3.3 We cannot accept your order until you have paid for it in full. You can pay with most major credit and debit cards by entering the relevant details on the checkout page.

3.4 Our site contains a number of products and it is always possible that, despite our best efforts, some products listed on our site may be incorrectly priced. We usually check prices as part of our shipping procedures, so we charge the lower amount when shipping the product to you if a product’s correct price is lower than our listed price. If the correct price of a product is higher than the price listed on our website, we will usually, at our discretion, either contact you for instructions before shipping the product or reject your order and notify you that we are rejecting the order. If the pricing error is clear and unmistakable and could reasonably have been recognized by you as an error, we do not have to deliver the products to you at the incorrect (lower) price.

3.5 By using a credit/debit card to pay for your order, you warrant and confirm that the card used is yours or, if not yours, that you are authorized to use it. All credit/debit card transactions are subject to validation checks and approval by the card issuer. If your card issuer refuses to approve payment, we will not accept your order. We are not obliged to inform you of the reason for the refusal and we are not liable for non-delivery. We are not responsible if your card issuer or your bank charges you a fee as a result of our processing your credit/debit card payment in accordance with your order.

3.6 We recommend that you do not provide your payment card information to others, including us, via email or chat. We cannot be held responsible for any damage you may incur when sending information to us via an Internet link, e-mail or chat. Such damage is entirely your own responsibility.

3.7 Please note the following with respect to digital products, services and applications offered by Safe Outdoor Shop that can be downloaded free of charge through the webshop. The data connection between the user’s device and the data server when using mobile online services, digital products or applications are not part of the services provided by Safe Outdoor Shop. Any exchange of data to download or use digital products, services or applications over the Internet may incur additional costs. This depends on the mobile phone and Internet subscription the user has, especially when used abroad (e.g. roaming charges). For information on the terms and conditions related to mobile phone and Internet subscriptions, users should contact their mobile or Internet provider.

4. Information on delivery and returns

4.1 Any delivery date stated on the website or in any document or email is approximate only and does not constitute a guarantee of delivery on any particular date.

4.2 Title and risk of loss shall pass to you upon delivery of the Products by us to the applicable carrier, unless otherwise agreed in writing by us.

4.3 Delivery charges will be added to the total amount due after you select a delivery service from the available options.

4.4 We deliver to the address specified in your order. You cannot change your shipping address after your order is placed.

4.5 You have the right under your legal rights to cancel your order, return a product or cancel a service agreement for any reason. If you wish to return a product purchased on the site, you must send your intention to return or cancel to us within 30 days of the date you, or a person designated by you, took delivery of the product(s). If you ordered multiple products in a single order, you must send your intention to return to us within 30 days of the date you, or a person designated by you, took delivery of the last product in the order. You only need to clearly communicate your intention to return a product to us to exercise these rights. If you would like to make a return, please send us a message to support@safeoutdoor.shop. We will then create a return for you, and then you will receive a return form from us.

Once you have notified us that you wish to return the product, please return the product to us with the original receipt, original packaging and included accessories. After you have indicated that you want to return a product or cancel a service agreement, you still have 14 days to return your products. You are responsible for the direct cost of returning these goods. You may be held liable if the value of the returned goods decreases as a result of your handling of the goods (except when it was necessary to determine the nature, characteristics and operation of the goods).

We will refund all payments received from you for the purchased goods and also refund the delivery charges for the cheapest delivery method we offer, no later than 14 days from the day we receive the above communication. We will use the same payment method you used for the original transaction, unless you have expressly agreed otherwise. In any case, no fees will be charged as a result of such a refund. We may delay the refund until we have received the goods again or provided you with proof that you have returned the goods, whichever is earlier.

Note: You may not return the following except in the case of a defect or conformity defect:

  • Electronic software downloads when the download has begun with your prior express consent and acknowledgment that you lose your right of withdrawal.
  • Services, after the Services have been fully provided, if the provision of Services has begun with your prior express consent and acknowledgement that you will lose your right of withdrawal after the Services have been fully provided. If the services have not been fully provided and you have requested that provisioning begin within 14 days of the service agreement cut-off date, you will be charged an amount proportionate to the services provided until such time as you have notified us of your intention to cancel the service agreement.
  • Sealed software whose seal has been broken after delivery.

5. Guarantees

5.1 The products you purchase are subject to the applicable limited warranty conditions and exclusions in effect at the time of shipment, as displayed on our website or as noted on the product packaging.

5.2 These limited warranty conditions do not affect your legal rights and are in addition to the consumer rights provided in EU law or the law of the country in which you reside if you are a consumer.

6. Product Information

6.1 We have taken reasonable steps to display the colors and other details of our products as accurately as possible in the images on our website. Since the actual colors and details you see on your screen depend on your monitor, we cannot guarantee that any colors or other details displayed on your monitor will exactly match the colors or details of the product you receive.

6.2 All information on the site regarding the dimensions of products is provided for guidance only. If you are unsure of a product’s size, we recommend you contact support@safeoutdoor.shop.

7. Our liability

Safe Outdoor Shop and its affiliates are not responsible for (i) damages not caused by any breach of our obligations, or (ii) any business damages (including lost profits, wasted expenses or loss of sales, contracts, anticipated savings, data or goodwill), or (iii) any indirect or consequential damages that were neither foreseeable by you nor by us when the sales contract for the products was entered into by us to you.

The laws of some countries do not permit some or all of the restrictions described above. If this legislation applies to you, some or all of the above restrictions may not apply to you and you may have additional rights.

Nothing in these terms limits or excludes our responsibility for fraudulent statements by us or for death or personal injury caused by negligence or willful misconduct.

We cannot be held responsible for any delay or failure to perform our obligations under these terms and conditions if the delay or failure arises from a cause beyond our reasonable control. This condition does not affect your right to have the products shipped to you within a reasonable time. If there is a delay before the products are shipped, we will not charge you for the products until they are shipped. You can cancel your order at any time before shipment.

9. Export restrictions

This agreement is subject to applicable export laws. You may not export products purchased from our webshop to another country or region if prohibited by export laws. If you plan to export a product to another country or region, you must obtain all legally required export licenses (or other government approvals) beforehand.

10. General

10.1 Our failure to enforce a right does not constitute a waiver of such right. You may not assign or transfer your rights under these Terms. Our failure to exercise all or any of our rights if you violate these Terms and Conditions shall not be deemed a waiver of such rights with respect to such violations or subsequent violations, nor do we imply any waiver by acceptance of any payment. Any such waiver shall be made only by an express written waiver signed by an authorized Safe Outdoor Shop representative. No waiver of any right relates to or affects any other right we may have, nor shall such waiver apply to any subsequent similar or non-similar breach.

10.2 The 1980 UN Convention on Contracts for the International Sale of Goods shall not apply.

10.3 If any part of these Terms and Conditions is found to be legally unenforceable, all other parts of these Terms and Conditions shall remain unchanged and shall remain in full force and effect.

10.4 These General Terms and Conditions are governed exclusively by Dutch law. Without prejudice to the application of mandatory provisions, you accept the jurisdiction of the courts of the Netherlands to settle any disputes that may arise out of these General Terms and Conditions. If you are a consumer and live in the EU, the law of your place of residence applies to any dispute covered by these Terms and Conditions. In that case, you can file a claim to enforce your consumer rights in connection with these Terms in the EU country where you live.
